Q&A: Ten Things You Need to Know About Boehner Suing Obama

Last week, the House of Representatives voted to authorize Speaker John Boehner to file a lawsuit challenging President Obama’s failure to fully implement Obamacare. Specifically, the lawsuit will challenge the administration’s delay of the employer mandate—requiring many employers to PROVIDE HEALTH INSURANCEDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png or pay a fine—that was supposed to go into effect Jan. 1. It’s clear President Obama repeatedly has abused executive power to circumvent Congress and essentially rewrite the law, but this lawsuit still raises a host of questions.
Q: Can you sue the president?
Yes. Presidents enjoy immunity from lawsuits for civil damages resulting from their official acts, but they are not immune from all lawsuits. For example, the Supreme Court allowed Paula Jones’ suit for sexual harassment against President Clinton to proceed while he was in office. Further, members of Congress have filed dozens of lawsuits against presidents over the years. Most have been unsuccessful, usually because members fail to allege a sufficient injury. Since Boehner’s lawsuit will deal with implementing Obamacare, the suit likely will be brought against Secretary of Health and Human Services Sylvia Burwell and other executive branch officials charged with carrying out the law. It’s possible Obama won’t actually be named in the lawsuit.
Q: Who will represent the House in court?
The House’s Office of General Counsel routinely represents the House in legal disputes, such as suits to enforce congressional subpoenas or the Speech and Debate Clause. In the past, the House also has hired outside counsel, such as when the House Bipartisan Legal Advisory Committee hired former Solicitor General Paul Clement to handle the Defense of Marriage Act litigation.
Q: How will this lawsuit be funded?
As with past lawsuits, the House will appropriate funds to pay for the litigation. The Committee on House Administration will make public quarterly statements in the Congressional Record detailing expenses.
Q: Does the Senate have a role?
The Senate probably is not required to join in the lawsuit. Under the Supreme Court’s precedents, members of Congress have standing to assert personal injuries or direct and concrete institutional injuries. In Coleman v. Miller(1939), the Supreme Court found a group of state senators demonstrated a sufficient institutional injury even though the suit was brought by 26 members of one chamber.
Q: Why would the House sue when it has other remedies?
Boehner has determined filing a lawsuit will be the most effective way to rein in the executive branch. Other remedies do exist—mainly appropriations and impeachment—but they require the Senate’s involvement. The House could try to leverage appropriations to encourage the president to faithfully execute the law, but as Boehner has pointed out, the Democratic Senate could refuse to pass such an appropriations bill. Similarly, impeachment requires conviction by two-thirds of the Senate. Although Boehner’s lawsuit may face obstacles, it would not require Senate concurrence.
Q: What happens if Obama loses?
Courts routinely enforce statutory mandates, such as the express deadlines in Obamacare that the executive branch has “relaxed.” Concerns the president would ignore the courts likely are unfounded. Even though Obama has complained about his losses, “There is no case in which he completely refused to follow a Supreme Court ruling he lost,” said Todd Gaziano,executive director of the Pacific Legal Foundation’s Washington, D.C., center.
Q: What happens if Boehner loses?
Before a court considers the merits of Boehner’s lawsuit, it first must decide whether the House has standing to bring this suit. If a court determines Boehner failed to establish Article III standing (a constitutional requirement for all lawsuits), it would result in dismissal of the case, but it would not mean the court agrees the president acted properly. If the suit is dismissed, it’s possible a private party may file suit, although the lack of private parties is one reason Boehner says his lawsuit is necessary. After members of Congress failed in their challenge to the Line Item Veto Act in Raines v. Byrd in 1997, the Supreme Court struck down the law when the City of New York and a group of private parties challenged it the next year.
Q: Didn’t Bush issue more executive orders than Obama?
Yes, but that is irrelevant to Boehner’s lawsuit. Executive orders are directives issued by the president to run the various parts of the executive branch—ranging from George Washington’s proclamation calling on the militia to put down the Whiskey Rebellion to Harry Truman’s order desegregating the armed forces. Most executive orders throughout our nation’s history are perfectly appropriate and non-controversial. Boehner’s lawsuit does not address Obama’s use of executive orders per se. Instead, the suit will challenge his failure to faithfully execute the law. The American Presidency Project, which has cataloged every executive order, says Bush issued 291 executive orders, Obama has issued 183 to date, and Franklin D. Roosevelt issued the most withmore than 3,500.
Q: Will this open the floodgates for Congress and the Executive Branch to turn to the courts to resolve their disputes?
No. There have been plenty of lawsuits brought by members of Congress against presidents and other executive branch officials in the past. The Supreme Court has been pretty clear that courts should not entertain “sore loser” suits where members of Congress sue over a vote they lost. This suit will not change the judiciary’s reluctance to get involved in political disputes between the other branches of government.
Q: Now that the House has authorized the suit, what happens next?

When craven world leaders such as Barack Hussein Obama insist that Israel actually negotiate with Hamas–it further propagates the liberal narrative that there is a moral
equivalence between the two.
And that–my friends–is nothing but BS.
Remember: Israel is simply responding to the myriad rocket attacks launched by Hamas at its civilian population. Rocket attacks, mind you–that are designed to inflict physical–as well as–psychological pain and suffering
And while Israel responds militarily–Hamas hides behind women and children in order to produce maximum casualties for its propaganda war against the Jewish State.
Yes, a propaganda war that resonates in the liberal precincts of the EU every time CNN and Al Jazeera air footage of dead Palestinian children.
Yet, despite the all the liberal shrill and hyperventilating–well informed individuals know that Hamas, and Hamas alone is responsible for the dead children in Gaza that CNN’s Brooke Baldwin endlessly despairs over.
Puhleez!
Manifestly, Baldwin and her mentally-impaired audience have never read the Hamas charter which includes the following: “The time will not come until Muslims will fight the Jews [and kill them]; until the Jews hide behind rocks and trees, which will cry: O Muslim! There is a Jew hiding behind me, come on and kill him.”
And, as we have witnessed–Hamas will do whatever it takes to “kill them” which includes using women and children as human shields and even suicide bombers.

US general assassinated in 'green-on-blue' shooting at Afghan army training base

A man in an Afghan Army uniform opened fire Tuesday at a military base, killing a U.S. general officer and wounding 15 people, among them a German brigadier general and a number of Americans troops
Pentagon spokesman, Rear Adm. John Kirby, said that the assailant fired into a group of international soldiers at the Marshal Fahim National Defense University at Camp Qargha, a base west of Kabul, and was subsequently killed.
Another 15 people, roughly half of them Americans, were wounded. Among the wounded were a German brigadier general, two Afghan generals and an Afghan officer, whose rank the Afghan Defense Ministry did not provide.
The attack occurred during a site visit to the university by coalition members.
Ministry spokesman Gen. Mohammad Zahir Azimi said a "terrorist in an army uniform" opened fire on both local and international troops.
The Qargha shooting comes as so-called "insider attacks" --  incidents in which Afghan SECURITYDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png turn on their NATO partners -- largely dropped last year. In 2013, there were 16 deaths in 10 separate attacks. In 2012, such attacks killed 53 coalition troops in 38 separate attacks.
Germany's military said 15 NATO soldiers were wounded in an assault launched "probably by internal attackers." The wounded included a German brigadier general, who the German military said was receiving medical treatment and was "not in a life-threatening condition."
NATO said it was investigating the attack, which Afghan President Hamid Karzai condemned as "cowardly."
It is "an act by the enemies who don't want to see Afghanistan have strong institutions," Karzai said in a statement.
Officials with the Taliban could not be immediately reached for comment.
Qargha is known as "Sandhurst in the sand"-- referring to the famed British military academy -- as British forces oversaw building the officer school and ITS TRAININGDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png program. In a statement, the British Defense Ministry said it was investigating the incident and that "it would be inappropriate to comment further at this time."
Soldiers were tense in the immediate aftermath of the shooting. One soldier in a NATO convoy leaving Camp Qargha fired a pistol in an apparent warning shot in the vicinity of Associated Press journalists who were in a car, as well as pedestrians standing nearby. AP photographer Massoud Hossaini said he and an AP colleague were about 15 feet from the soldier at the time.
"The vehicle before the last one, someone shouted at me," Hossaini said. "The last one, the soldier opened fire."
No one was wounded.
Such "insider attacks" are sometimes claimed by the Taliban insurgency as proof of their infiltration. Others are attributed to PERSONALDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png disputes or resentment by Afghans who have soured on the continued international presence in their country more than a dozen years after the fall of the Taliban's ultra-conservative Islamic regime.
Foreign aid workers, contractors, journalists and other civilians in Afghanistan are increasingly becoming targets of violence as the U.S.-led military coalition continues a withdrawal to be complete by the end of the year.
In eastern Paktia province, an Afghan police guard also exchanged fire Tuesday with NATO troops near the governor's office, provincial police chief Gen. Zelmia Oryakhail said. The guard was killed in the gunfight, he said. It wasn't clear if the two incidents were linked and police said they were investigating the incident.
Meanwhile Tuesday, a NATO helicopter strike targeting missile-launching Taliban militants killed four civilians in western Afghanistan, an Afghan official said Tuesday. NATO said they were investigating the attack.
The attack in western Herat province comes as civilian casualties from NATO attacks remain a contentious issue across the country. Almost 200 people protested against NATO in Herat on Tuesday, carrying the bodies of the dead civilians into the provincial capital and demanding an investigation.
In a statement, NATO said it was aware of the attack and was investigating, without elaborating.
Civilians increasingly find themselves under fire as the 2001 U.S.-led war draws to a close, as Afghan forces take the lead in operations targeting the Taliban. The civilian death toll in the war in Afghanistan rose 17 percent for the first half of this year, the United Nations reported in July. The U.N. said 1,564 civilians were killed from January through June, compared with 1,342 in the first six months of 2013.
Insurgents were responsible for 74 percent of the casualties, the U.N. said, while pro-government forces were responsible for 9 percent, government forces 8 percent and foreign troops 1 percent. The rest could not be attributed to any group.
Karzai has repeatedly clashed with NATO over civilian casualties and strongly condemned the helicopter attack Tuesday.
Afghan security forces also increasingly find themselves under attack as the planned foreign troop withdrawal draws near. On Tuesday, a police car struck a roadside bomb in the eastern province of Nouristan, killing three officers, provincial police chief Abdul Baqi Nouristani said. OBAMA’S UNPRECEDENTED IMPEACHMENT DARE

Tell me: Has any other United States president ever goaded the opposition party to bring impeachment proceedings against himself? Has any other so sneeringly mocked and taunted the other party?
President Obama is not only not the uniter he promised to be; he is the agitator in chief. Just consider the contrast with President George W. Bush, who didn’t even defend himself often, much less deride, needle and dare Democrats to oppose him.
It’s just like Obama, the dutiful disciple of 1960s leftist radical Saul Alinsky, to divert our attention from his official misconduct by demonizing Republicans and conservatives rightfully challenging his lawlessness.
Obama knows he has habitually exceeded his executive authority, but it’s not so much the frequency of his overreaches that is unique. He boastfully claims he hasn’t issued so many executive orders as his predecessors did. But that’s just more of his misdirection.
It’s not unlike his absurd statement that there has been more OIL DRILLINGDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png under his administration than under others. What tripe. He conveniently omits that most of the drilling has occurred on private, not government-owned, land.
It’s the substance of his executive orders — their dangerous scope and magnitude — that makes them so dangerous and troubling. Even liberal law professor Jonathan Turley notes that it is not the number of his executive orders that matters but their content and reach.
We must recognize that he is doing this premeditatedly. Shortly before issuing his executive order to implement parts of the Development Relief and Education for Alien Minors Act, he openly acknowledged — in lobbying for passage of the DREAM Act — that he had no constitutional authority to do it on his own. But when he couldn’t get Congress to go along with his ill-advised bill, he issued the order anyway, in total defiance of Congress’ legislative prerogative and of his own ADMISSIONDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png that he couldn’t do so.
The law is no obstacle to him. He will not be denied. His latest ploy is to ridicule Republicans for blocking his various amnesty schemes, which he euphemistically describes as “comprehensive immigration reform.” He says he wouldn’t have to act on his own if Congress would do its JOBDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png. His adviser Dan Pfeiffer said, “The president has no choice but to act” on immigration.
Excuse me? Congress’ JOBDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png is not to rubber-stamp his statist policies. It is not to get along with him. Its duty is not to President Obama, his agenda or his legacy. It is to do what it believes is best for America and to check his power when he is acting beyond his authority.
There is nothing in the Constitution or case law that empowers a president to act unilaterally when Congress won’t go along with him. If this were the case, the Constitution and its entire system of separation of powers would be meaningless.
How cynical this man is to tell the American people that he has a right to act outside the scope of his authority if his intention is “to HELPDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png people” — as if to turn lawlessness into a virtue. How can members of his own party not be sickened by his contemptuousness toward the Constitution? This isn’t just a matter of Obama’s jabbing the Republican Party. It’s a calculated assault on the Constitution that transcends partisan politics and will come back to haunt all Americans.
Obama realizes that his egregious record in office has finally come home to roost and that in November, assuming things CONTINUEDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png on their current course, his party is going to receive a shellacking at the polls because of him.
This is why he is willing to go to any lengths to distract attention from his failures. He figures the best way he can do that is by further vilifying Republicans as irresponsible extremists, racists, bigots, homophobes and the rest, hoping that he can dupe Americans into ignoring his disastrous record by convincing them that Republicans would be even worse.
He desperately needs to gin up his base and energize his own extremists, and his tried-and-true method for the past six years to accomplish that has been to use fear-mongering against Republicans.
So he is not only ratcheting up his rhetoric to accuse Republicans of a plot to impeach him, though House Speaker John Boehner has clearly indicated that is not in the cards, but also trying to force their hand into actually impeaching him. To this end, he is planning on upping the ante by issuing a far-reaching unilateral order granting amnesty to millions.
That’s right. The leader of the Free World is trying to provoke Republicans into impeaching him or otherwise stirring a constitutional crisis.
This is stunningly unprecedented. But more and more people are wising up to his serial abuses of power and his partisan agitation.
I don’t have a great track record as a prognosticator of elections, but I am strongly sensing his party, as a direct result of his policies and lawlessness and its shameless refusal to rein him in, is going to get a titanic comeuppance in November.

Four suspects have been arrested in the shooting deaths of two New Jersey teens – one a straight-A prep school student and the other a recent high school graduate.
Ali Muhammad Brown, 29; Jeremy Villagran, 19; Andre Fields, 31; and Eric Williams, 18, were arrested and charged separately in the deaths of Brendan Tevlin, 19, and 17-year-old Cheyanne Bond.
The two victims were killed in separate attacks in and around Newark, the largest and most-dangerous city in the Garden State.
Tevlin was reportedly shot dead June 25 in his SUV after being robbed of several items. He graduated from a local prep school with straight-A’s and was attending Richmond UNIVERSITYDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png. His sophomore year was due to start later this month, according to NJ.com.
Williams reportedly stayed behind the wheel of a getaway car while Villagran and Brown had a conversation with Tevlin before firing eight bullets into him, authorities said.

NATO: The Broken Promise Has Backfired–Ukraine

NATO was created in 1949. The North Atlantic Treaty Organization broke an American tradition. It was a defensive alliance. The United States had been involved only one such alliance in the past: the French alliance of 1778, which led to the defeat of the British at Yorktown in 1781.
The French treaty was permanently severed in 1800 by the Treaty of Mortefontaine. For the next 149 years, we did not enter into such a foreign alliance.
NATO was Truman’s umbrella over Western Europe. It was part of the Truman Doctrine. It was part of his creation of a national SECURITYDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png state.
In 1989, James Baker III, who had been Reagan’s Chief of Staff, and who was now Bush’s Secretary of State, sat down with Gorbachev. He made a promise: if the USSR took APARTDescription: http://cdncache-a.akamaihd.net/items/it/img/arrow-10x10.png the Warsaw Pact, NATO would not move one inch closer to the USSR. In 1991, the USSR was officially dissolved. A new Russian state replaced it — much smaller.
Clinton broke the promise in 1996. NATO has moved steadily eastward, bringing in mini-states that the U.S. government does not need to defend. NATO should have been dissolved no later than 1992.
We are now trying to bring Ukraine into NATO. That has gone too far for Putin, as well as the eastern Ukraine.
Each side is rattling sabers, rhetorically speaking. In this case, Russia has the larger saber: its geography — next door to Ukraine — and its natural gas exports to Western Europe.

If you don't read this, and do nothing about it, don't complain when it affects you or your loved ones!!!!! This is the second Judge to have read the Obama Care document comments. More highlights of Nancy's 
"pass it and Then find out what's in the bill"!!!

Show this to everyone nearing the ripe old age of 76. These are just a few of the things that we Seniors are going to have to deal with starting in 2014. Even far left Democrats will not like these.

Your hospital Medicare admittance has just changed under Obama Care.You must be admitted by your primary Physician in order for Medicare to pay for it! If you are admitted by an emergency room doctor it is
treated as outpatient care where hospital costs are not covered. This is only the tip of the iceberg for Obama Care.

happens in 2014!

Judge KITHIL of Marble Falls , TX - highlighted the most egregious pages of HB3200 Please read this....... especially the reference to pages 58 & 59 JUDGE KITHIL wrote: ** Page 50/section 152: The bill will provide insurance to all non-U.S. residents, even if they are here illegally.
** Page 58 and 59: The government will have real-time access to an individual's bank account and will have the authority to make electronic fund transfers from those accounts.
** Page 65/section 164: The plan will be subsidized (by the government) for all union members, union retirees and for community organizations (such as the Association of Community Organizations for Reform Now -
ACORN)
** Page 203/line 14-15: The tax imposed under this section will not be treated as a tax. (How could anybody in their right mind come up with
that?)

** Page 241 and 253: Doctors will all be paid the same regardless of specialty, and the government will set all doctors' fees.
This is what they do in Sweden too. I know because Alf's daughter Ann is an OBGYN, and her husband, Thorsten, is a surgeon.........
** Page 272. section 1145: Cancer hospital will ration care according to the patient's age.
** Page 317 and 321: The government will impose a prohibition on hospital expansion; however, communities may petition for an exception.
** Page 425, line 4-12: The government mandates advance-care planning consultations. Those on Social Security will be required to attend an "end-of-life planning" seminar every five years.(Death counseling..)
** Page 429, line 13-25: The government will specify which doctors can write an end-of-life order.

HAD ENOUGH???? Judge Kithil then goes on to identify: "Finally, it is specifically stated that this bill will not apply to members of Congress.
No wonder they did not see the need to read it....doesn't apply to them!!! THE AMERICAN PEOPLE NEED TO STAND UP TO WASHINGTON ..... I don't know if we can do anything, but awareness helps.
