like what actually happened at the time of your arrest. What would you do? How
would you respond? How would you defend yourself?
Most of
us would argue that the state’s story was a lie and then we would tell them
what really happened… but who would the court believe? Would the court believe
the arrested criminal or the state law enforcement officers who are supposed to
be the good guys?
This
scenario played out for a Bloomfield, New Jersey man, and he
almost went to prison because of it.
After a domestic
dispute encounter, Marcus Jeter left his home in Bloomfield; several minutes
later he was pulled over by police who charged him with eluding police,
resisting arrest and assault. Mr. Jeter faced time in prison over the encounter
– but he said the police reports were complete lies. Even his lawyer thought he
was the one lying. Fortunately for Jeter, a 2nd dash cam tape that police had been
hiding eventually surfaced during the trial – proving his story and showing
proof positive that the police reports were falsified and the officers had lied
about what happened. (At around 2:30 into the video you can watch and hear as
the officer lies and acts out for the cameras about what Mr. Jeter is doing.)
What is most scary about this situation is that it could happen to anyone,
anywhere in the country – if the government so chooses. The government has
access and control at every stage of a criminal trial. If the government
chooses, evidence can disappear and testimony can change. It is one reason that
those arrested are supposed to always have a presumption of innocence – but far
too often that isn’t the case. This may be an isolated incident in a corrupt
police department, but it’s also a reminder of the power the government has
over each one of us and why we should remain skeptical of our government at all
times. Even if President Obama says otherwise.

AMENPER: La
Institucionalidad del Fraude
Todo el que
ha estado de una u otra manera envuelto en el sistema de asistencia pública,
conoce que el fraude es la causa de que el sistema sea el drenaje mayor de
fondos del dinero de los contribuyentes y el aumento de la deuda nacional.
Cuando el
presidente Obama implementó su Obamacare, cortó más de 600 billones por los
próximos 10 años en gastos futuros del Medicare, y nos presentó la falsa
realidad que el Obamacare se había pagado por sí mismo. Esto fue un
preámbulo a lo que después ha sido la institucionalidad del fraude con el
Obamacare.
Una mejor
opción, si realmente querían resolver el problema de la salud hubiera sido
atacar agresivamente los fraudes del Medicare y el Medicid lo que hubiera
cubierto el programa y hubieran sobrados fondos..
Esto es sólo
una demostración que la ayuda de asistencia social es un sistema político más
que un sistema para dar ayuda a los necesitados.
Es raro el
día que pasa sin que veamos en los periódicos casos de fraude que ha costado al
gobierno (esto es los contribuyentes) millones de dólares.
Pero cuando
leemos las noticias, vemos que los que son condenados son los proveedores del
Medicaid y Medicare.
Esto no
soluciona el problema, por el sistema de la oferta y la demanda, nuevos
proveedores surgen, y el fraude continúa.
El fraude no
se puede cometer por los proveedores solamente, los cuales son justamente
condenados, pero para hacer el fraude necesitan la complicidad de los
recipientes del programa.
El problema
es que el gobierno no quiere condenar a estos recipientes, porque son su base
política, son los que dependen del gobierno y votan por los políticos
paternalistas.
Cuando estos
proveedores facturan al Medicaid-Medicare, necesitan en número del paciente y
su aprobación de los falsos servicios. Estas personas reciben una
suma por debajo de la mesa por su complicidad.
Esto viene
sucediendo por un largo rato, pero con el Obamacare se ha duplicado.
El Obamacare
incita a las personas a que se inscriban con el programa a través del
Medicaid. El fraude ahora comienza desde el momento en que se
inscriben, cuando reportan información falsa para calificar en el programa. El
Obamacare no investiga la información la acepta, lo que le interesa es que se
inscriban. El Obamacare no es un programa de salud, es un programa político.
Estas
personas dependientes de la asistencia pública sin necesitarla, crean un número
mayor de personas bajo la asistencia pública, y personas que desde su entrada
ya están cometiendo una acción fraudulenta, así que ya sabemos lo que podemos
esperar de sus futuras acciones.
La asistencia
pública es necesaria, siempre hay personas que por los azares de la vida tienen
que recibir ayuda para subsistir. Pero estas personas son las más
afectadas por el fraude institucionalizado por motivos políticos. Si
se eliminara as estos parásitos de la asistencia pública, hubiera suficiente
dinero para asistir a los que realmente lo necesitan.
Es triste
sobre todo el caso de los que contribuyeron toda su vida para el Medicare
y ahora verán sus beneficios reducidos para pagar por los que el gobierno
instan a cometer fraude como un método para conseguir votos.
El sistema
actual del HHS de pagar y entonces perseguir, es una invitación al fraude, y
los criminales, ´proveedores y recipientes, están muy complacidos con la
situación. Los que no estamos muy complacidos somos los contribuyentes.
Si el
Obamacare realmente quisiera resolver el problema de la salud, terminar con el
fraude sería la solución, y esto hay que ejecutarlo desde el momento de
la iscripción a losl programas.
No se
resuelve aceptando inscripciones fraudulentas para inflar los números de los
que se inscriben en el programa basado en el Medicaid.
Creo que la
solución se verá solamente cuando se socialice completamente el sistema de
salud.
Entonces
con el pagador único que sea el gobierno, quizás acabe con el fraude.

El
Consumismo como arma contra el comunismo.
Cuando estábamos en Cuba en 1959, cuando la
mayoría del Pueblo Cubano estábamos oyendo Radio Rebelde desde la Sierra
Maestra y a los oficiales de la dictadura Batistiana desde los medios de
comunicación, siempre dejé un espacio, y nunca perdí de vista el peligro
comunista a nivel mundial que siempre fue mi preocupación latente. Una
preocupación que me ayudó a detectar el carácter comunista de Fidel Castro en
su libro la historia me absolverá y temprano en la victoria para reconocer el
plan para tomar el poder total eliminando a factores como el Directorio
Estudiantil y el Segundo Frente del Escambray, para con este poder total
implementar la transición al socialismo sin barreras.
En ese año de 1959, comenzó en
Moscú, una Exposición Estadounidense con los objetos de
productividad y prosperidad de la vida en los Estados Unidos. El objetivo
principal de los americanos era que la Unión Soviética diversificara su
producción para reducir la producción de la industria pesada. Si la Unión Soviética
comenzaba a poner sus recursos hacia la producción de bienes de consumo,
también significaría una reducción de material de guerra-cultura.
Pero fueron los productos que enseñaban el
medio de vida americano, el consumismo americano, lo que creó en los soviéticos
el deseo de poder adquirir esos mismos productos en sus países. Y
para poder hacer eso había que cambiar el sistema de gobierno. Hay
un dicho que dice que “El amor entra por la cocina”, el fin del comunismo entró
por la cocina. El Debate de la Cocina en la exposición de 1959 en
Moscú entre Khruschev y Nixon, fue un intento de Khrushchev a oponerse como de
costumbre al consumismo occidental. El "régimen de Khrushchev había
prometido abundancia para garantizar su legitimidad." Pero dentro del
comunismo, esto es imposible. De hecho los dos mayores “logros” del comunismo
son lograr que el pueblo limite sus excesos gastronómicos y que termine el
consumismo.
No hay nada que comer ni nada que comprar, así
que “voluntariamente” el pueblo cumple esos objetivos. Pero la
Exposición abrió una nueva ventana, la ideología de estricta funcionalidad con
respecto a bienes materiales evolucionó hacia una visión más relajada del
consumismo. Este período de acercamiento al consumismo de los ciudadanos soviéticos
se denominó como “Operación abundancia" también fue conocida como la
"guerra de Nylon" que predijo que "pueblo ruso no tiempo
toleraría a maestros que les dieron tanques y espías en vez de aspiradoras y
salones de belleza." Los soviéticos tendrían que producir más bienes de
consumo para sofocar el descontento masivo y ellos no sabían cómo hacerlo. Fue
el deseo de la búsqueda de la libertad política para poder obtener la
libertad económica del consumismo lo que terminó con el comunismo en Europa
Utilizando el odio de la guerra de clases, el
socialismo del siglo XXI ha logrado como en Cuba hacer de países con economías
más o menos aceptables, en que existían los productos de primera necesidad y
artículos para hacer una vida mejor para las familias, convirtiéndolos en las
sociedades miserables que siempre se crean el comunismo.
Pero todo es cuestión de tiempo, en la antigua
Unión Soviética las intenciones de la resurrección socialista está encontrando
oposición, como en el caso de Ucrania.
En Venezuela vemos como si no fuera por el
otro logro del comunismo, que es la represión totalitaria, ya el pueblo de
Venezuela se hubiera liberado del comunismo.
El consumismo
promueve el desarrollo real de nuestras sociedades orientándose al progreso
humano, que al serlo, entonces dará pie a la re-distribución de las riquezas en
las sociedades en convivencia sana y sin diferencia a los estratos
económicos.
El consumo es
algo natural. Consumimos antes de nacer, desde el vientre materno estamos
consumiendo Consumir no sólo es natural para nosotros los humanos,
el consumo es parte de los procesos naturales de sostenimiento y reproducción
de la vida. El consumir es una parte del proceso de intercambio de los seres
vivos con el ambiente inmediato y mediato. Desde los primeros seres
que poblaron nuestro planeta el consumo ha estado presente en todo momento.
Consumimos por fuerza y en razón de nuestra propia naturaleza, queremos
consumir lo que nos gusta para ser más felices. No hay manera de existir sin
realizar un intercambio con el entorno por medio del consumo. Sí, el consumo es
una necesidad absoluta.
El consumismo
es parte esencial de la búsqueda de la felicidad del hombre, no es en las
privaciones cuando somos felices sino en el consumismo. Cuando por la libertad
logramos consumir lo que deseamos hemos logrado la felicidad.
Esto está
implícito en la declaración de independencia cuando dijeron los padres de la
patria:

At first it may sound shocking, but the last
audit of gold stored in Fort Knox took place in 1953. No typo here,
1953, just after U.S. President Dwight Eisenhower took office. Even though it
is the last audit up to date, it can’t be described as satisfying. No outside
experts were allowed and the audit team tested only about 5% of gold hoarded in
the fort. So, there hasn’t been a comprehensive audit
of Fort Knox in at least 60 (!!!) years. This is at least surprising,
given the fact that large entities listed on stock exchanges are usually
required to undergo an outside audit at least once a year. Of course, the U.S.
Bullion Depository is no conventional company. Nonetheless, not auditing it
independently for more than half of the century raises questions such as the
one posted above.
This is no new topic. One of the
first written accounts questioning the amount of gold really stored in Fort
Knox appeared in 1974 in a tabloid, the National
Tattler. An unnamed informant claimed that
there was no gold left in Fort Knox. The sensational nature of the story, and
of the newspaper, wouldn’t perhaps contribute to the credibility of the account
but it was later revealed that the informant, Louise Auchincloss Boyer,
secretary to Nelson Rockefeller, had fallen out of the window of her New York
apartment and died three days after the publication in the Tattler. The tragic incident
resulted in controversies over the possibility that the U.S. Bullion Depositary
may have misstated the actual amount of gold held in Fort Knox. Congressman
John R. Rarick demanded a Congressional investigation and, on September
23, 1974 six Congressmen, one Senator and the press were allowed to enter Fort
Knox to see for themselves if the gold was there or not.
The tour showed that there was gold in Fort Knox but,
all the same, it sparked even more controversies. Only a fraction of the gold
reserves were available to see. A photo of one Congressman published by
Associated Press suggested that gold bars held in the fort may have been less

Excepto en el
camaleón, una de las característicasanatómicas
más comunes de los depredadores, es
tener los ojos en el frente de la cabeza y enfocar ambos en lamisma
dirección. Esa característica se hace muyevidente en las aves.
El águila, el
halcón, las múltiples especies de gavilanes ytodas las aves
de rapiña nocturnas miran y enfocan de frente, tienen una
visión extraordinaria y su habilidad de
localizar un objeto desde una distancia muy superior a lade la
visión del ojo humano es notoria. El resto de las aves
tienen los ojos a ambos lados de la cabeza y pueden enfocar a dos
objetivos simultáneamente: visión defensiva.
A diferencia de
sus víctimas, la localización de los ojos yla mirada
hacia el frente son también común
denominadorpara todos los grandes depredadores terrestres.
Entre todos ellos, amigo lector, el más peligroso es el hombre.Quien ponga en duda esa realidad
física debe mirarse al espejo.
Sobrevivir con
mayor o menor éxito el proceso histórico de Cuba durante los últimos
54 años equivale a una
experiencia extraordinariamente traumática. Una
experiencia como la de aquel quien aprendió el peligro que representa del
fuego porque se ha quemado ambasmanos.
La narración
que sigue es absolutamente real, aunque el lector debe
tener en cuenta que la memoria siempre juega trastadas después
de algún tiempo. Los nombres han sido omitidos por un sinnúmero de
razones, todas válidas. Las fechas son muy aproximadas.
Cuando en
diciembre de 1956 la agitación política en Cuba estaba en su apogeo, empezaron
a producirse actos violentos que se caracterizaban por un ciclo de acción y
reacción. En ese mismo mes se cerró indefinidamente la Universidad
de La Habana por decisión del Claustro, quizás con el objetivo de proteger
la integridad física de los estudiantes.
Diversos
enfrentamientos ya se habían producido entre estos últimos y la policía en, o
alrededor de la legendaria escalinata que ascendía desde la Avenida de San
Lázaro hasta “el Alma Mater”. Esos choques en que me
involucrémarginalmente y en los que una
vez resulté lesionado, dejaron un saldo muy negativo de heridos (por
lo menos un muerto), muchos arrestados y no pocos daños materiales.
Cerrada la
Universidad y enfrentado a las necesidades diarias de la vida, no
tenía otra opción que obtener un empleo regular en plazo
breve. Desde hacía bastante tiempo trabajaba temporalmente para
varias oficinas de arquitectura o ingeniería civil-estructural. Ese trabajo eramal remunerado e ingrato. Aunque
la semana laboral en Cuba era entonces de 44 horas, la mía era sólo entre 0 y
8.
Además, continuar
asistiendo regularmente a la Escuela de Arquitectura y al
mismo tiempo trabajar en tiempo completo era misión
menor que imposible. La inmensa mayoría de los compañeros de
labor eran jóvenes estudiantes, sufriendo los mismos problemas
que yo. Porregla general el supervisor era la misma persona y el
único individuo con que tratábamos. Como es natural, empleaba y despedía de acuerdo a los contratos
obtenidos. El cierre de la Universidad forzó mi decisión.
La carrera de
arquitectura en Cuba requería 7 años de estudios y las únicas opciones para
los estudiantes de esa disciplina eran entonces la
Universidad de La Habana o la privada Universidad de
Villanueva. La tercera opción era contar con los
medios económicos para vivir en Estados Unidos y asistir allí a una universidad
privada.
En
La Universidad de La Habana podíamos matricular
anualmente por una cantidad ridículamente modesta. Una de
las grandes mentiras del castrismo es afirmar que en Cuba sólo podían
estudiar los ricos. Eso se convirtió en realidad para mí sólo
después que se cerrara la Universidad de La Habana.
Yo vivía
con mis padres, pero ellos carecían de los medios de fortuna para sufragar
mis estudios en Villanueva y mucho menos en el
extranjero. Por esa época mi hermano trabajaba y estudiaba en
Washington D.C., con una beca de estudios censales en
Estados Unidos a través de su empleo en la Oficina del
CensoElectoral de Cuba. Recién cumplidos los 22 años de
edad, yo necesitaba urgentemente hacer algo con mi vida.
Habiendo llenado
todos los requisitos en un buró de empleos técnicos y profesionales,
fui llamado a una entrevista para trabajar en una fábrica de marcos de
puertas, ventanas y gabinetes de cocina (de madera) en la ciudad
de Marianao, al este de donde vivía. La comunicación
era bastante buena y la fábrica estaba a 30minutos
de mi residencia.
La entrevista no
pudo haber sido más positiva. El empresario era un
individuo muy reservado, devotocatólico y totalmente dedicado
a su negocio. Sus funciones eran ventas y relaciones
públicas. Nunca dejaba que asuntos personales o de otra índoleinterfirieran
con su negocio.
Tenía dos
socios. Uno era bastante mayor de edad, buen mecánico y estaba a
cargo de mantener la maquinaria de la fábrica. A
ese apenas lo traté. El tercero era de elevada
estatura y corpulento. Hablaba siempre a gritos y nunca
paraba de gesticular. Su divisa era una gorra de peloteroque se
encasquetaba hasta las orejas y que nunca se quitaba. No sé si tenía
pelo. Sin embargo era un tipointeligente y campechano, guajiro
legítimo. Sus obligaciones en el negocio eran supervisar todas las operaciones
de la fábrica y enviar la producción a su
destino.
Recuerdo que fue
en su casa y durante la celebración del cumpleaños de su hija cuando por la
primera de dos
únicas veces en mi vida se me fue la mano con elalcohol. Alguien me llevó
a mi casa, pues no podía conducir. La otra ocasión fue
cuando me licencié delEjército de Estados Unidos: amanecí en
mi casa y en micama, de completo uniforme
y con los zapatospuestos. Sólo me faltaban algunos dólares
del bolsillo.Otro soldado en el grupo
tiene que haber estado peor que yo. Recuerdo que le propuso
matrimonio a lamuchacha que servía en el bar, a quien nunca había
vistoantes. Tres semanas más tarde se casaron. La última vez
que los vi, años después, increíblemente aún eran felices.
Mis funciones
para la fábrica de Marianao eran visitar a clientes o
edificios en construcción armado con una lienza, un
“clipboard”, dos minúsculos cartabones, hojas de 8.5 por 11 y un
lapicero para tomar medidas y hacer los bosquejos o diagramas necesarios con
los que el taller pudiera fabricar las piezas adecuadas. Fue durante
esa época que aprendí a conducir en el entonces formidable tráfico de
La Habana y sus entornos (en un Chevy del 51,
propiedad del negocio).
Fui despedido de ése mi
primer empleo serio y con
sobrada razón: encontraron en el baúl del Chevroletliteratura
política. No una hojita suelta ni dos, sinopaquetes de periódicos. El jefe
de ventas me dijo que aunque personalmente estaba de acuerdo con el mensaje, no podía permitir que su
negocio, del que mucha gente dependía, se viera en peligro a causa de mi
irresponsabilidad.
Me despidió pero
no me dio “bola negra”. Unas pocassemanas después, recomendado por el
mismo buró que me consiguiera la posición en la fábrica de Marianao, fui
empleado por Maderera Antonio Pérez S.A., uno de los negocios de materiales de
construcción más importantesy florecientes de La Habana, para
trabajar en sudepartamento de ventas. Esa posición tenía cuando el negocio
fue confiscado sin compensación por el Régimen Castrista en el
otoño de 1960, junto a otras trescientas industrias: me convertí en
empleado involuntario del estado.
A punto de salir
de Cuba en el verano de 1961, visité mi antiguo trabajo buscando
presupuesto para una nave queabsurdamente y contra toda lógica quería
levantar otroamigo en un lote de su propiedad. Me encontré con el jefe
de producción, quien tenía la gorra másencasquetada en su
cabeza que nunca. Vivía muy cerca de la fábrica y lo visité en
su casa. Abrió la puerta y me indicó que habláramos en el portal.
“¡Nos acaban de robar el negocio!”, me gritó, agregando: “¿Te
acuerdas de tu antiguo jefe, quien era tan católico? Botó el
catolicismo para el c… de su… y ¡ahora es más comunista que la madre que lo
parió!”Con un gesto iracundo de la cabeza me indicó que
mirara a la derecha.
Vi a varios de los operarios de
la fábrica mirándonos con odio mal disimulado, parcialmente ocultos
bajo la sombra del techo del viejo taller. Sin excepción, los
recordaba como los más adulones de los ejecutivos entre todos los antiguos
empleados.
Estudié con
curiosidad sus expresiones faciales y en particular
sus resentidas miradas. Eran las miradas de
depredadores.
Terrifying Evidence
of How the Government Could Treat Us
Imagine
that you have been arrested and the story told to you in court sounds nothing
like what actually happened at the time of your arrest. What would you do? How
would you respond? How would you defend yourself?
Most of
us would argue that the state’s story was a lie and then we would tell them
what really happened… but who would the court believe? Would the court believe
the arrested criminal or the state law enforcement officers who are supposed to
be the good guys?
This
scenario played out for a Bloomfield, New Jersey man, and he
almost went to prison because of it.
After a
domestic dispute encounter, Marcus Jeter left his home in Bloomfield; several
minutes later he was pulled over by police who charged him with eluding police,
resisting arrest and assault. Mr. Jeter faced time in prison over the encounter
– but he said the police reports were complete lies. Even his lawyer thought he
was the one lying. Fortunately for Jeter, a 2nd dash cam tape that police had been
hiding eventually surfaced during the trial – proving his story and showing
proof positive that the police reports were falsified and the officers had lied
about what happened. (At around 2:30 into the video you can watch and hear as
the officer lies and acts out for the cameras about what Mr. Jeter is doing.)
What is
most scary about this situation is that it could happen to anyone, anywhere in
the country – if the government so chooses. The government has access and
control at every stage of a criminal trial. If the government chooses, evidence
can disappear and testimony can change. It is one reason that those arrested
are supposed to always have a presumption of innocence – but far too often that
isn’t the case. This may be an isolated incident in a corrupt police
department, but it’s also a reminder of the power the government has over each
one of us and why we should remain skeptical of our government at all times.
Even if President Obama says otherwise.

and don’t trust federal judges, to make sure that we’re abiding by the
Constitution with due process and rule of law, then we’re going to have some

Michelle Obama Thinks You’re a Blockhead. /
Michelle Obama's recent
helpful comments about how young people are "blockheads" and need to
enroll in Obamacare because they could be injured "dancing"
or cooking ... are telling. Her husband, the smartest guy in the world, has
illustrated how important teleprompters are, and how they can spare us all lots
of embarrassment. When he leaves the T-prompter at home and ventures into
the "real world" he can say painfully dumb things. One of my personal
favorites was when he was quoting the Psalmist and misread the word
"bow." He pronounced the word as it is used to describe what he does
in the presence of the Saudi royal family. (Remember the Saudis? They came to
power by assassinating the former dynasty members. They also provided the young
fellows who hijacked the planes on September 11.)
This was
a period early during the Obama dynasty when he was trying to woo (I guess) the
"religious right" instead of calling them "clingers."
Painfully, the correct rendition of the word "bow" was apparent
to even the meanest understanding by the context of the Psalm containing it.
The reference of the Psalmist was to a time when the "archer's"
weapons would be no longer needed. "Bows" and arrows will no longer
be needed, some day, when war shall be made no more. Reading can be tricky.
Reminds
me of the time Howard Dean said his favorite New Testament book was
"Ecclesiastes." I don't think this remark woke up any of the
"press corpse" but King Solomon may have taken exception.
Poor
Michelle didn't mangle the meaning of some Ancient Passage with which she was
totally unfamiliar. She was just speaking her mind. Off the cuff. And while
doing so, she revealed her ignorance of what her hubby and Congress have
foisted on the rest of us. Those of us who cling bitterly to The Book and
"guns." Not to mention lusting after those tony $12,000 evening gowns
she wears to state dinners in the White House (which I'm sure stay in some
National museum where the artifacts relating to former First Ladies are
preserved for posterity after she has dropped off the national scene). She
doesn't understand Americans who live in Realsville.
Her
statement, which seemed to have been uttered in seriousness, illustrates how
frivolous this group is.
"Dancing?"
"Cooking?" Give me a break! How about oldsters like me? Can't I get
hurt cooking? (It nearly happened the other night when my wife foolishly
entrusted me with the task of "browning" some breadcrumbs destined to
stuff some small chili peppers. It seems I kept them in the skillet a few
moments too long. This foolish error on my part nearly resulted in an early
demise (which probably isn't covered under Obamacare...funeral expenses,
that is) (although, I'm sure the physical symptoms associated with emotional
trauma is ...at least for young "blockheads"). And why can't I get
injured dancing on a bar stool? I can get hurt at my age doing just about
anything people normally do. I would, admittedly, be a little out of my element
in any bar...particularly in bars where dangerous activities are engaged in.
The only time I spent any serious time in an establishment where intoxicants
are served was in law school when I was tricked into accompanying a buddy to a
favorite food joint, when the buddy (who was driving) actually was going to a
bar next door where an impromptu post mid-term exams celebration was being
held. I didn't engage in any dangerous dancing, but I did get to meet a new
friend who was the only other teetotaler present. While our classmates were
sliding under the table we had an interesting extended conversation about our
backgrounds and dreams. I think he had been shanghaied, too.
We both
emerged unscathed and not needing nationalized single payer health care.
Life was
simpler then, but, of course, Reagan was in the White House.

Equality

At America's
founding and throughout the 19th century, the crowning ideal was that of
liberty—natural rights largely protected by free trade and enterprise in a
large, commercial republic. This was part of a principled solution by the
founders to the discord and tyranny that plagued earlier republics and stifled
human potential.
The founders
were concerned about destructive, passionate factions forming in a democracy,
among them factions between rich and poor. Their solution was to ensure enough
freedom and liberty so that the effects of factionalism and discord would be
moderated by and through commercial opportunity.
Nowhere does the Constitution even remotely mention equality or any
general governmental redistribution of the fruits of individual liberty. If
liberty must be replaced by equality, we should be told why this change must
occur. I fear that President Obama's response, and that of all the
progressives, is to wish to control the causes of factionalism: to either
reduce liberty or to try to make us more equal in our passions and interests by
"spreading the wealth around." This instills in our republic elements
of despotism that the founders abhorred and found contrary to human
flourishing. As such, the path President Obama is pursing is the exact opposite
of the one purposefully chosen and articulated by the founders. Unless we
reverse this trend, we may learn only from our failings that the founders were
wise to adjudge human nature and so clearly articulate the unworkability of and
ethical deficiencies embodied in the very path our progressive leaders are
increasingly pursuing.

Revenue Service's proposed regulations regarding tax-exempt nonprofit
organizations, submitted to the IRS by seven signatories including Floyd
Abrams, Harvey Silverglate and Nadine Strossen, Feb. 24:
We are a group
of First Amendment advocates who have championed free speech in judicial
proceedings, legislative chambers and in the court of public opinion. In our
view the proposed IRS regulations providing guidance for tax-exempt non-profits
with respect to "candidate-related political activity"
("CRPA") will impose serious burdens on free speech and hinder the
democratic processes it serves. Our basic concern is that the new concept of
"candidate-related political activity," which sweeps within its ambit
some of the most important public information and social advocacy work of so
many Section 501[c][4] organizations, will have a chilling effect on such
organizations by either causing them to self-restrain from engaging in the most
important work of informing the public on the critical public policy issues of
the day or forcing them to adopt the ill-fitting garb of Section 527 political
organizations and the deterring disclosure of contributors which would ensue.
It is no secret
that the proposed new regulations come against the background of allegations
that the Service has engaged in political favoritism in the enforcement of
current guidelines for Section 501[c][4] organizations. That, of course, is one
of the most serious assertions that can be made against the IRS which depends
so heavily for its success upon the public's belief that its actions are
scrupulously neutral and non-partisan. The NPRM indicates that the goal is to
clarify the ground rules and to "provide greater certainty and reduce the
need for detailed factual analysis in determining whether an organization"
meets the Section 501[c][4] criteria. . . . Of course, that is a valid concern
in an area of regulation which touches so directly on rights guaranteed by the
First Amendment to the United States Constitution. Vague rules are particularly
suspicious in the First Amendment area, because uncertainty about the meaning
of the law is a handmaiden of a chilling effect and deterrence on political
speech and association. . . . But just as dangerous as vague laws in the First
Amendment area are seriously overbroad ones, i.e. laws which reach well beyond
the valid area of government proscription and regulation. It is our submission
that particularly in this regard the key elements of the proposed new
regulation are deeply deficient and will cast a pall over the vital exercise of
First Amendment rights by non-profit organizations, the key constituents of
"civil society" which make our democracy so vibrant.
